Sport Personality & Athletes Privacy Notice

Information on Players, Managers, and Other Individuals Involved in Sports

We process data on known football players, managers (such as team coaches), sports personalities, and other individuals involved in sports (“Sports Data”). This data is obtained from third-party sources, like contracted data providers and online information service providers. For example, for football, the data may include:

  • Initials: The initials of the individual.
  • Full name: The complete name of the individual.
  • Club where the individual is currently employed: The current club or team the individual is associated with.
  • Previous club: The club or team the individual was previously associated with.
  • Team and league information: Details about the team and the league in which the individual participates.
  • Position(s) played: The position(s) the individual plays in the sport.
  • Goals scored: The number of goals the individual has scored.
  • Shirt number: The number on the individual’s shirt.
  • In squad (Y/N): Whether the individual is in the squad.
  • Starting: Whether the individual is in the starting lineup.
  • On bench: Whether the individual is on the bench.
  • Yellow cards: The number of yellow cards the individual has received.
  • Red cards: The number of red cards the individual has received.

Note: Most other sports are in scope for ”sports data”, and it should be clear that the data in scope for other sports will vary, depending on whether itโ€™s a team or individual sport and these will also have sport relevant statistics. Sensitive Personal Data and/or special categories of personal data

We do not gather or process such data and do not plan to do so in the future. This ensures that we respect the privacy and confidentiality of all individuals involved.

Purpose

The purpose of processing sports data is to enable online and retail customers to place bets. This helps us provide a better service to our customers by offering accurate and up-to-date information.

Automated Decision Making / Profiling

There is no automated decision-making or profiling applied to sports data in the wider meaning of local data protection regulations.

Lawful Basis for Processing Sports Data

Our lawful basis for processing sports data is legitimate interests. This means that we process the data in a way that we deem necessary for our business operations to:

  • Facilitate the sports and gambling industries, which allow end users to place bets on sports, which you may be partaking in.
  • Provide player sport profiles as part of our digital services offering to our clients end users, to place bets on sports,
  • Offering and settling player-related betting markets of sporting fixtures for trading services;
  • Monitoring and detecting potentially fraudulent activity in sports betting markets to identify betting-related manipulation in sport.
  • Development and improvement of Playtech products and services.

The data processing stated in this Sport Personality/ Athletes Privacy Notice, is based on legitimate business interests, not individual consent. However, as someone who falls under the categories of Sport Personalities / Athletes, you can still request data corrections or access, and unnecessary data can still be erased. Please also note, there could be some loss of control over the data processed, due to increased and ever evolving Sports data and personal use. If you are someone falling into the categories of Sport Personalities / Athletes, please also consult with your professional bodies and clubs, membership organisations, agencies and other forms of management who are responsible for the public release of your data.

Data Subject Rights

The rights of data subjects are outlined below:

  • You can ask to see the personal information we hold about you.
  • You can request your personal information in a format that machines can read.
  • You can object to us processing your data if it’s based on our legitimate interests, but we might still process it if there are other legal reasons or strong grounds to continue.
  • You can ask us to correct any inaccurate personal information.
  • You can ask us to delete your personal information if it’s no longer needed or if itโ€™s inaccurate.
  • You can complain to the Data Protection authority. See complaints section for Data Protection regulator details.

To exercise your rights, you can also contact us. Note that we may not always be able to fulfil your request fully. We might need proof of identity to verify your request and may ask for more details. We aim to respond within a month of verifying your identity.

Transfers of Sports Data

Currently, in our B2B arrangements, we make sports feeds available to Gambling operators around the world, meaning there are data transfers and recipients of Sport Feed data outside the UK / EEA. Where transfers are to non-adequate countries, we would apply safeguards like the Standard Contractual clauses (EU), or the international Data Transfers addendum (UK). The recipients of the sports feed data are each considered Data Controllers, who own and manage their own compliance obligations under local data protection laws which these data controllers are subject to. If you wish to know who these other data controllers are, we will support in making available a point in time list of data controllers, upon request.

Categories of Recipients

  • B2B (Business-to-Business): Gambling Operators: Who make the sports data available to its own end users, the Online or Retail players
  • B2C (Business-to-Consumer): Online players and retail players: Individuals (natural persons) who use our contracted services.
  • Cloud service providers for storage/transfers: Companies that provide cloud storage and transfer services.
  • Internal IT/ Product functions: Our internal teams that manages and processes the data.

Retention Periods for Sports Data

In our B2C areas, we maintain internal data retention policies for any personal data we process. The relevant retention periods are based on our analysis of how long the specific sports data is reasonably required for legal or other confirmed business purposes. When no longer required, any personal data will be securely deleted or destroyed. Data used only for reporting and analysis is maintained for as long as necessary. We ensure that all data is handled responsibly and securely.

Where your personal information is associated with a bet, there are legal requirements to retain your personal information along with all other betting information that are associated with the bet. These retention times vary in per country from 5 years (UK) to (for example) 10 years in some European countries

Data controllers who we share the sport data with, will have their own obligations, which we would have no control over, so you may need to contact the relevant data controllers in scope. Please refer to the Transfers of Sport data section.

Responsible Controller

The responsible controller is Playtech Software Limited. We are committed to ensuring that your data is handled responsibly and in accordance with all relevant laws and regulations. However, please note the sources of Sport Personalities / Athletes data as well as businesses acting as recipients of the same, are also data controllers for such data. These are additional data controllers outside our responsibilities (see also below under โ€œAdditional Informationโ€).

Additional Information

We have commercial agreements in place for the gathered information from sports feed providers, who are also independent data controllers in their own right. This information is then provided to gambling operators, who are also data controllers. Each data controller has their own legal obligations towards sports personalities and athletes, ensuring that their data is handled responsibly and in compliance with relevant data protection laws. Playtech Software Limited is not taking any responsibility on behalf of these external companies.
